{"id":11346,"date":"2014-11-26T08:31:05","date_gmt":"2014-11-26T13:31:05","guid":{"rendered":"https:\/\/familycouncil.org\/?p=11346"},"modified":"2014-11-26T08:33:34","modified_gmt":"2014-11-26T13:33:34","slug":"family-council-calls-marriage-ruling-judicial-tyranny","status":"publish","type":"post","link":"https:\/\/familycouncil.org\/2014\/11\/26\/family-council-calls-marriage-ruling-judicial-tyranny\/","title":{"rendered":"Family Council Calls Marriage Ruling &#8220;Judicial Tyranny&#8221;"},"content":{"rendered":"<p><strong>FOR IMMEDIATE RELEASE<br \/>\nTuesday, November 25, 2014<\/strong><\/p>\n<p>On Tuesday U.S. District Judge Kristine Baker struck down Amendment 83 to the Arkansas\u00a0Constitution defining marriage in Arkansas as the union of one man and one woman.<\/p>\n<p>Family Council President Jerry Cox released a statement in response to the ruling, saying, \u201cThis is another example of\u00a0judicial tyranny. Arkansans voted overwhelmingly to define marriage as the union of one man and one woman. Their\u00a0elected officials voted for that definition when they passed Arkansas\u2019 Defense of Marriage Act. By issuing this ruling,\u00a0one federal judge is saying seventy-five percent of Arkansas voters and lawmakers do not matter. If that isn\u2019t tyranny,\u00a0I don\u2019t know what is.\u201d<\/p>\n<p>Cox said the ruling sets a troubling precedent. \u201cWhat Judge Baker effectively did was erase Arkansas\u2019 definition of\u00a0marriage. It opens the door for marriage to become anything. We have already seen <a href=\"http:\/\/bit.ly\/1thezQ4\" target=\"_blank\">polygamists in Utah<\/a> and\u00a0elsewhere try to ride the coat tails of same-sex marriage activists in court. Rulings like this one only fuel those\u00a0efforts.\u201d<\/p>\n<p>Cox said this case is almost certain to land before the U.S. Supreme Court. \u201cThis fight is far from over. Judge Baker\u00a0has put a stay on her ruling until the Eighth Circuit, which includes Arkansas, issues a ruling. The Sixth Circuit Court\u00a0of Appeals recently ruled that marriage amendments like Arkansas\u2019 are constitutional. Any time you have federal\u00a0judges disagreeing about what is constitutional, the case is almost guaranteed to go to the U.S. Supreme Court. I hope\u00a0the higher courts exercise enough restraint to respect the wishes of voters.
